SMETHPORT — A Smethport man pleaded guilty Thursday in McKean County Court to charges in three different cases.
Charles M. Johnson, 35, is charged in one case with flight to avoid apprehension and resisting arrest, in a second case with simple assault and in a third case with theft of leased property. According to Assistant District Attorney Sean Barrett, on Feb. 6, 2015, Johnson treated a PS4 PlayStation Bundle he leased from Rent-A-Center as his own; on Oct. 7, 2015, he ran from a police officer who was trying to arrest him and caused the officer to use substantial force in order to carry out the arrest; and on Nov. 6, 2016, he hurt Jeffrey Morton during a mutual struggle at McKean County Jail.
He will be sentenced March 16.
Also in court, Misty R. Mihalko, 31, of Bradford, pleaded guilty to charges stemming from three separate cases. She is charged in one case with possession of 29 Adderall pills and two OxyContin pills and driving under the influence of a controlled substance; in a second case with possession of crack cocaine and in a third case with possession of drug paraphernalia.
She will be sentenced March 16.
Chance M. Gray-Foster, 21, of Bradford, pleaded guilty to charges of recklessly endangering another person, criminal mischief and a summary charge. According to District Attorney Stephanie Vettenburg-Shaffer, on Nov. 13, 2016, Foster, who was highly intoxicated, kicked the door down at 15 Oxford St., damaging it, because he thought it was his sister’s house; it was not his sister’s house, and a child of about 3 years old was asleep on a couch near the door when Foster broke in. He will be sentenced March 16.
Colby E. Lyle, 36, of Sheffield, pleaded guilty to a charge of recklessly endangering another person and summary charges. On May 1, 2016, Lyle was arguing with a woman while operating a vehicle and struck another vehicle; an infant girl was also in his car at the time of the crash, according to Barrett. He will be sentenced March 16.
Kasey M. Chittester, 33, of Kane, pleaded guilty to a charge of welfare fraud. Between Dec. 1, 2015, and May 31, 2016, Chittester failed to report income she received from the Texas Hots in Kane and received $2,929 in SNAP benefits and heating assistance funds to which she was not entitled, said Barrett. She will be sentenced March 16.
Jason M. Musolino, 30, of Bradford, pleaded guilty to charges of simple assault and resisting arrest. On Jan. 3, 2017, Musolino choked a woman, then, when police tried to arrest him, he resisted, necessitating that police use a Taser to arrest him, according to Assistant District Attorney Ashley Shade. He will be sentenced March 16.
Auston G. Howard, 19, of Eldred, pleaded guilty to a charge of driving under the influence of alcohol and a summary charge. He will serve six months of probation.
Michael J. Magee, 27, of Smethport, pleaded guilty to charges of possession of a small amount of marijuana and possession of drug paraphernalia. He will serve 12 months of probation.
Robert L. Hamilton II, 26, of Port Allegany, pleaded guilty to a charge of possession of drug paraphernalia. He will be sentenced March 16.
The following people were accepted into the Accelerated Rehabilitation Disposition program: Courtney Black, 42, of Bradford, and Julie Cummins, 50, of Bradford, both for driving under the influence of alcohol; Andrew T. Baker, 35, of Port Allegany, for DUI alcohol and/or a controlled substance; and Amanda J. Whiteman, 24, of Duke Center, and Kara D. Britton, 28, of Bradford, both for retail theft.
Robin M. Defrance, 39, of Kane, plead guilty to a summary charge of defiant trespassing. She will pay a $100 fine.
