JOHNSONBURG — A Johnsonburg man has been charged in district court after allegedly hitting another person with his car during a confrontation.
Joshua David Johnson has been charged with a felony charge of aggravated assault, a misdemeanor charge of accidents involving death or injury, and summary offenses of operating a vehicle without a valid inspection and failure to notify police department of an accident.
An affidavit of probable cause was obtained from the office of Magisterial District Judge James L. Martin.
The affidavit said an individual, identified in the affidavit as “A.R.,” reported to police that he and Johnson were to meet on Jan. 28 for a fight. Court documents said A.R. was walking down Grant Street in Johnsonburg when he saw Johnson’s vehicle come to a stop in the area before revving its engine, squealing its tires, and swerving towards A.R.
A.R. was reportedly hit by the vehicle, which was allegedly driving around 30 mph. Court documents said A.R. flew into the windshield and broke it in several places. Then, A.R. and Johnson allegedly engaged in a fight before Johnson drove A.R. home.
A.R. was reportedly taken to Penn Highlands Elk in St. Marys for treatment of a concussion and lacerations on the right side of his face.
When contacted by police, Johnson reportedly admitted to the incident, saying that he “made a mistake and didn’t want to get into trouble, so he never reported the accident.”
Johnson is scheduled for a preliminary hearing before Martin at 2:30 p.m. March 1. Online court documents do not list an attorney for Johnson. The Commonwealth will be represented by the Elk County District Attorney’s Office.
