SMETHPORT — A Bradford woman accused of causing serious injuries to another woman during an assault pleaded guilty on Thursday in McKean County Court.
Kiana Z. McNamara, 21, entered the plea to one count of aggravated assault. Assistant District Attorney Ashley Shade explained that on Aug. 20, 2016, McNamara injured Stacy Knapp by punching and kicking her several times while Knapp was on the ground, causing a nasal fracture, bleeding on the brain and a puncture wound to the head. She will be sentenced Feb. 9.
A codefendant in the case, David Cabisca, has asked that his charges go to trial. No trial date is set.
Also in court, Nicholas A. Zentz, 21, of Bradford, pleaded guilty to a charge of flight to avoid apprehension. According to District Attorney Stephanie Vettenburg-Shaffer, on Oct. 29, 2016, Bradford City Police were searching for Zentz because he was wanted as a fugitive, having an active arrest warrant from New York state for absconding. An officer pulled over to talk to Zentz, and when the officer put his hand on Zentz’s shoulder and told him he was under arrest, Zentz fled on foot, running into the woods. This prompted officers from several departments and bloodhounds to conduct a search, which had to be called off at night for officer safety. A civilian tip led police later that night to Zentz’s location, where he was taken into custody. He will be sentenced Feb. 9.
Josh J. Bodistow, 32, of Kane, pleaded guilty to a charge of simple assault. On Sept. 16, 2016, after a physical altercation between Bodistow and another man, Bodistow followed the victim outside while swinging a crowbar, which he then used to strike the victim’s windshield while the victim was inside, said Shaffer. Bodistow will be sentenced Feb. 9.
Mark D. Burlingame, 33, of Smethport, pleaded guilty to charges of possession with the intent to deliver a controlled substance and criminal use of a communication facility. According to Shaffer, on May 13, 2016, Burlingame delivered two morphine tablets to a confidential informant with the McKean County Drug Task Force and used a communication facility to set up the sale. Burlingame will be sentenced Feb. 9.
Krystle L. Causer, 32, of Kane, pleaded no contest to theft-related charges in four cases. She is charged in three cases to retail theft and in the fourth case to theft by unlawful taking. The reason for the no contest plea is that Causer suffers from memory problems. “Some of these things she literally can’t remember,” said her attorney, Douglas Garber. According to Assistant District Attorney Sean Barrett, between May 10 and June 6 in 2016, Causer took a donation container with $50 in it from That Natural Store in Kane, took $9.89 worth of merchandise from the Label Shopper in Foster Brook and on two occasions took merchandise from Walmart, taking $173.53 worth of merchandise one time and $275.93 worth second. She will be sentenced Feb. 9.
Tiffany L. Osborne, 35, of Duke Center, pleaded guilty to charges in two cases. She’s charged in one case with four counts of theft by deception and in the second case with three counts of theft by deception and one count of corruption of minors. According to Barrett, from July 24 to 26 and from Aug. 24 to 29 in 2016, Osborne pretended to be selling pizzas for a benefit for a local man injured in an accident, taking a total of $132 from seven people; she also had a juvenile female aid in the crime by making phone calls to some of the victims. She will be sentenced March 2.
Ryan P. Frame, 45, of Smethport, pleaded guilty to a charge of criminal trespassing. On Oct. 6, 2016, Frame’s dog was temporarily in the McKean County SPCA, and Frame threw a brick into the organization’s back window, damaging the property and avoiding payment of a $25 fee, according to Shaffer. He will be sentenced Feb. 9.
Richard A. Waldeck Jr., 18, of Mount Jewett, pleaded guilty to charges of criminal mischief and receiving stolen property. On Aug. 15, 2016, Waldeck received a stolen revolver worth $399.99 and he discharged a firearm into a concession stand, damaging it, said Barrett. He will be sentenced Feb. 9.
Ace D. Simmons Jr., 36, of Bradford, pleaded guilty to a charge of disorderly conduct and a summary charge. On Oct. 23, 2016, Simmons, who was highly intoxicated, went to Bradford Regional Medical Center, where he was rude and verbally offensive to staff and would not leave, said Shade.
Brittany N. Robinson, 24, of Bradford, pleaded guilty to a charge of retail theft. On May 29, 2016, Robinson took $179 in Pennsylvania Lottery tickets and $94 in cash from Kwik Fill while she was employed there, according to Barrett. She will be sentenced Feb. 9.
Accepted into the Accelerated Rehabilitative Disposition Program were Christopher M. Mawn, 20, of Eldred, for possession of drug paraphernalia; and Joshua M Bretherton, 26, of Bradford, for driving under the influence of alcohol.
