SMETHPORT — A Bradford man who is also facing federal drug charges was sentenced Thursday in McKean County Court for a prior county case.
Nineteen-year-old Ryan J. Buterbaugh pleaded guilty Aug. 11 in county court to charges of possession with the intent to deliver a controlled substance and possession with the intent to deliver a designer drug; however, when he did not appear for his Sept. 1 sentencing hearing, a bench warrant was issued for his arrest.
Since that time, more drug charges have been filed against Buterbaugh in McKean County. When he was eventually taken into custody, he was incarcerated without bail. Also, court records indicate he is facing federal charges in the Western District Court of New York.
On Thursday, Buterbaugh was sentenced to a term of nine to 23 months of incarceration with credit for one day of time served for allegations that on Aug. 28, 2015, Buterbaugh possessed 1.89 grams of cocaine, 11.66 grams of butyryl-fentanyl and 11 glassine bags containing less than 1 gram of butyryl-fentanyl.
At the time charges were filed, police indicated that on Aug. 28, 2015, investigation into drug activity at the home led them to obtain a search warrant for his 13 Jefferson St. home, where they found multiple drugs.
On Sept. 28 this year, the McKean County Drug Task Force filed another case stemming from three alleged drug sales.
He is charged in the new case with four counts of possession with intent to deliver a controlled substance, three counts each of dealing in proceeds of unlawful activities and possession of a controlled substance and one count of criminal use of a communication facility, court records indicate.
Court records said that on April 29, Buterbaugh sold two grams of crack to an informant; on May 3, he sold 1.5 grams of crack cocaine; and on May 24, he sold 2.5 grams of crack.
Regarding the federal charges, Buterbaugh is accused of conspiring to deliver 28 grams of cocaine, according to court records.
A preliminary hearing on the new county charges is scheduled for Jan. 4.
