A Bradford man is facing criminal charges after an alleged assault that left the victim complaining of hearing loss in one ear.
Damian James Bundy, 25, of 67 Southgate Road, Bradford, was arraigned Tuesday before Magisterial District Judge Dominic Cercone on charges of simple assault, a first-degree misdemeanor; and harassment, a summary charge, court records stated.
Court records said Bradford City Police responded to a fight at 54 High St., where Kyle Keller said he was assaulted by Bundy and could not hear out of his left ear.
Police pulled over Bundy, who was driving a van down High Street, and arrested him for assault allegations; he told police he knew nothing of the assault.
A breathalyzer test at the police station indicated that Bundy had a blood alcohol level of .108 percent, court records stated. The legal limit for motorists is .08 percent in Pennsylvania. Court records do not indicate that Bundy is facing any driving-related charges as of Tuesday afternoon.
In addition to hearing loss, court records stated that Keller had bleeding from his right ear and the left side of his head. He went to Bradford Regional Medical Center for treatment.
Witnesses indicated that Bundy became jealous of Keller because he was talking to Brittany Pursell, and he became jealous over a discussion about smokeless tobacco, according to court records; Keller alleged that Bundy hit him and wrestled with him for at least 10 minutes, and he didn’t stop until Keller made the decision to defend himself. Then Bundy left.
Bundy was committed to McKean County Jail in Smethport in lieu of $10,000 bail. He is scheduled to appear in Central Court on Dec. 22.
