Two men arrested after an alleged altercation — one charged with trespassing and other in a subsequent assault — waived preliminary hearings Monday before Magisterial District Judge David Engman.
The quarrel between the men arose from a drug deal, court records indicated; however, neither is facing drug-related charges in the incident.
Josh Joseph Bodistow, 32, of Kane, is charged with aggravated assault, a first-degree felony; simple assault, a second-degree misdemeanor; and summary harassment; while Russell Ferraro, 36, of Kane, is charged criminal trespassing, a third-degree felony; and summary harassment, court records stated.
Court records said on Sept. 16, Ferraro entered the Wetmore Township home of Bodistow, where they argued after a drug deal. Ferraro taunted Bodistow, saying “hit me, hit, if you don’t I will,” records read.
Bodistow complied, hitting Ferraro in the head with a crowbar, fracturing his skull, court records stated. Then, Bodistow allegedly followed Ferraro to his vehicle and struck the driver’s side window, shattering it, while Ferraro was in the driver’s seat.
Bodistow is incarcerated in McKean County Jail in Smethport in lieu of $10,000 bail — decreased from $35,000 in October — and Ferraro is in jail in lieu of $20,000.
