ST. MARYS (EC) — A Johnsonburg woman facing a felony charge of possession with intent to deliver in Armstrong County has been arrested and charged in St. Marys after allegedly being found in possession of various drugs when sheriff’s deputies acted upon an arrest warrant.
In Elk County, Kaitlyn Marie Buerk, 24, has been charged with three misdemeanor counts of intent to possess a controlled substance by a person not regulated, two misdemeanor counts of use or possession of drug paraphernalia and one misdemeanor count of tamper with or fabricate physical evidence.
An affidavit of probable cause outlining the charges was obtained from the office of Magisterial District Judge Mark S. Jacob.
According to the affidavit, sheriff’s deputies traveled to Sylvania in St. Marys on Thursday to serve a warrant on Buerk. She had an active bench warrant from Armstrong County for failing to appear for a trial on Oct. 11 on drug charges, according to the affidavit.
Online court documents show that Buerk is representing herself in this case.
With the active bench warrant from Armstrong County, deputies with the Elk County Sheriff’s Department located Buerk in St. Marys.
According to the affidavit, when deputies approached Buerk, she allegedly placed something in a Taco Bell bag that was near her.
Deputies placed Buerk under arrest and searched her, allegedly finding five empty glassine stamped bags, a glassine stamped bag containing heroin, a schedule III controlled drug (Buprenorphine) and a schedule IV controlled drug (Clonazepam).
As a result of the incident, Buerk has also been charged in Elk County.
She is confined in the Elk County Prison.
She is scheduled to appear before Jacob on Dec. 6 at 10:30 a.m. for a preliminary hearing.
