JOHNSONBURG — A Penfield man that is currently incarcerated in Elk County Prison in Ridgway is facing new charges after he allegedly assaulted a fellow inmate in the prison.
Dustin Isaac Rhoads, 30, is facing a misdemeanor charge of simple assault and a summary offense of harassment after an incident at the prison that allegedly occurred on Oct. 17.
An affidavit of probable cause outlining the incident was obtained from the office of Magisterial District Judge James L. Martin.
The affidavit indicates that Rhoads and a fellow inmate at the county prison became involved in a verbal dispute. When the victim turned around, Rhoads allegedly began to punch the victim in the back of the head multiple times, according to the affidavit.
The victim was left with lumps and redness to the back of his head and bruising to his knuckle, according to the affidavit.
A mobile X-ray unit was called to the prison to check on the victim, and according to the affidavit, the X-rays came back with negative results.
Rhoads reportedly suffered injuries in the incident as well, according to court documents.
The affidavit indicates that Rhoads had to be transported to a medical facility as his hand was red and swollen, which left Rhoads unable to bend or move his fingers.
Elk County is listed in the affidavit as the victim for the payment of medical bills.
The assault was recorded on video and a copy had been made, according to court documents.
Rhoads is scheduled to appear for a preliminary hearing before Martin at 9 a.m. Nov. 23.
Online court documents do not list an attorney for Rhoads. The Commonwealth will be represented by the Elk County District Attorney’s Office.
