EMPORIUM (EC) — Two residents of Emporium are facing multiple charges, including felony counts, for receiving and selling stolen property.
Co-defendants Caleb Smith, 25, and Jenna Rockey, 24, both of West Sixth Street in Emporium Borough, have each been charged with receiving stolen property, dealing in the proceeds of unlawful activities and knowledge that property is the proceeds of an illegal act. Two of the counts are felonies.
The affidavit of probable cause on file at Magisterial District Judge Barry Brown’s office indicates that police were alerted to the theft of a Nintendo 3DS video game system by the victim, who noticed that it had disappeared approximately one week prior to his report.
The victim stated that a friend of his mother’s, who works at Game Stop in St. Marys, related that someone attempted to sell a 3DS to the store. Allegedly, the transaction could not be completed because the individual did not have any identification. Emporium Police Officer Patrick Straub contacted the location and was able to obtain security video of the individual who attempted to sell the item.
The affidavit states that Straub recognized Smith to be the seller on the tape and asked the victim if Smith had ever been at his residence. The victim stated that Smith is a relative his roommate and was in the apartment when the victim arrived home. The victim stated that Smith was “in his house passed out with a syringe next to him,” when the victim arrived home from work.
Records indicate that the victim related that Smith contacted him and admitted to him that he had sold his 3DS at the DuBois Game Stop. Through the investigation, Straub learned that Smith’s accomplice, Rockey, had sold the game system and one game at the DuBois location for $100, according to the affidavit.
Smith was taken into custody on Friday for a non-appearance warrant issued by Brown’s office for a preliminary hearing on an unrelated matter scheduled for Thursday. He is currently being held in lieu of $25,000 straight cash bond. Arraignments on the above charges have not yet been held or scheduled.
