JOHNSONBURG — A Wilcox man has been charged in district court after allegedly resisting arrest when law enforcement officials attempted to arrest him on an arrest warrant from Elk County.
Drew David Ferguson, 36, has been charged with a misdemeanor charge of resisting arrest or other law enforcement and a summary offense of harassment.
An affidavit of probable cause outlining the incident was obtained from the office of Magisterial District Judge Mark S. Jacob.
The affidavit said the incident began on Oct. 12 around 6:30 p.m. as troopers were notified of a domestic dispute in progress at a residence along Marvin Street in Wilcox. Before troopers could arrive on scene, Ferguson had allegedly fled the scene and returned to his home along Faries Street.
Troopers were able to determine that Ferguson had an active arrest warrant out of Elk County, so troopers went to his home. The affidavit indicated that Ferguson was advised of the warrant but refused to come out of his house.
Then, the victim in the domestic dispute went into the residence to try to talk to Ferguson.
The affidavit said Ferguson immediately locked the door, grabbed the victim by the arm and pushed her. Troopers then forcefully gained entry into the residence. Court documents said Ferguson then ran out of the residence through the front door and refused to acknowledge commands to stop running.
Troopers were able to apprehend Ferguson in the neighbor’s yard but allegedly continued to refuse to comply with trooper’s commands. The affidavit indicates that Ferguson refused to place his hands behind his back after being apprehended.
As a result of the incident, Ferguson has been charged. Online court documents do not list a date for a preliminary hearing. Further, no defense attorney is listed for Ferguson.
The commonwealth will be represented by the Elk County District Attorney’s Office.
