SHINGLEHOUSE — The company often referred to as Wayne Paving is
working its way through the bankruptcy process it launched in
January, when it filed a voluntary petition under Chapter 11 of the
United States Bankruptcy Code (Title 11).
At that time, the company that also does business as Wayne
Companies and Wayne Paving and Contracting filed under the name of
Wayne Gravel Products Inc.
The companies are headquartered at 262 Route 44, Shinglehouse.
The president is Wayne A. Stephen.
This month has brought a flurry of motions, hearings and orders,
and court permission to employ a new lawyer, James Minarcik. There
was more than one motion to extend time for filing a disclosure
statement and plan, one dismissed and the other granted.
The deadline for filing a plan or an amended plan was extended
from May 25 to Aug. 25. Stipulations were filed by major
creditors.
As of Wednesday evening, Mr. and Mrs. Wayne Stephen were on
route to their home near Cuba, N.Y., after another day in Erie, the
location of the U.S. Bankruptcy Court for the Western District of
Pennsylvania.
The 20 companies holding the largest unsecured claims against
Wayne Gravel range from Cemex of Chicago, with $642,466.06 owed to
it, down to BASF Construction Chemicals of Chicago, $5,401.66.
IA Construction is listed as due more than $70,196. Lesser
amounts are owing to Erie Insurance, a Shinglehouse tire and rental
company and Wayne Stephen himself.
Estimates of assets and estimates of liabilities fall in the $1
million to $10 million range, but liabilities outweigh assets
considerably.
The Wayne Companies Web site says the company is headquartered
in Shinglehouse with satellite offices in Bradford and Springville,
N.Y. Its service area is said to be “primarily Western New York and
Northwestern Pennsylvania, but “new opportunities have taken us to
areas as far as Northwestern PA, but new opportunities have taken
us to areas as far as Maine and Florida.”
The site sates that customers include government agencies,
private and public institutions, commercial and industrial
enterprises, contractors and homeowners.
Coudersport and Warren are listed as locations for Wayne
Companies, along with the Shinglehouse, Springville and Bradford
bases.
A notation on the site says a new Web site with new information
are under construction and advise, “Check back later.”
Wayne Companies put up a concrete ready mix plant in Bradford in
April of 2006. Construction projects, including work on the U.S.
Route 219 Bradford bypass, were the apparent reasons for adding
concrete preparation capacity there.
